I recently clicked a wedding reception. I received a hot check. The person is avoiding me?
I did not have the party sign marriage contract because it was last minute and it was a favor for a (named) friend. I did the service for $ 150, and the check came back insufficient. Now when I call this lady, I have a response, or avoid all together. "I can take this to small claims court? What are my options?
The check is a legally binding document. It is a contract that tells the bank to pay you (the beneficiary) $ 150 to those who pay the bill. The Purchaser has breached this contract by not have the money in the account. They certainly are incurring NSF charges from your bank. Your choices are: 1. Redeposit the check or go directly to your bank for the money. You may not have had the cash in your account when you went before, but have it now. 2. Write a letter of application indicating they are in breach of contract non-payment of services. They owe $ 150 + fees incurred when your check. Ask to pay in cash, money order or cashier's check. 3. Bring to the small claims court, though it may cost more than $ 150 in court costs, working time and trouble.
